Terms and conditions

Article 1: Preamble

The present conditions of sale are concluded, on the one hand, by the company Marcipont Adrien whose registered office is located in Belgium, registered with the Banque Carrefour des Entreprises under the number 535 586 191 hereinafter referred to as LA DENT DU CHAT and, on the other hand, by any individual or legal entity wishing to make a purchase via the Internet site "ladentduchat.com", hereinafter referred to as the "user".

The user who wishes to purchase on the site declares having full legal capacity.

Any person who is incapacitated, notably in the sense of articles 1123 and following of the Civil Code, cannot in any way purchase on the site.

Consultation of the site and the services it offers are then the responsibility of their legal representative. This legal representative is required to comply with these stipulations.

In any event, when transmitting personal data, the legal representative must compile the registration form himself/herself or expressly authorise the person he/she represents to complete the said form, with the stipulations relating to personal data naturally applying.

The parties agree that their relationship will be governed exclusively by this contract to the exclusion of all other conditions.

Should any condition be lacking, it will be governed by the practices in force in the distance selling sector in accordance with Belgian law.

Article 2: Purpose

The purpose of these conditions of sale is to define the contractual relationship between LA DENT DU CHAT and the buyer and the conditions applicable to all purchases made through the seller's site, whether the buyer is a professional or a consumer. The acquisition of a good or service through this site implies unreserved acceptance by the buyer of these conditions of sale. These conditions of sale shall prevail over any other general or specific conditions not expressly approved by the seller. LA DENT DU CHAT reserves the right to modify its conditions of sale at any time. In this case, the applicable conditions will be those in force at the date of the order by the purchaser.

Article 3: Orders

The user may place an order online from the site references.

The order can only be registered on the site if the user has clearly identified him/herself.

Any order implies acceptance of these General Terms and Conditions of Sale as well as the prices and description of the products sold.

LA DENT DU CHAT undertakes to honour orders received on the website only within the limits of available stocks of products.

If an item is out of stock, LA DENT DU CHAT may deliver a similar item with equivalent or superior characteristics at an equivalent price.

Within 24 hours of the order being placed, LA DENT DU CHAT will send the user a confirmation email to the email address provided.

Article 4: Recording of personal data

Any natural or legal person who registers during a visit to the www.ladentduchat.com website as a potential contracting party communicates their personal data by registering.

Registration implies explicit consent that this identification data may be processed in LA DENT DU CHAT's data file.

Only legal entities or natural persons with full legal capacity may register.

During the registration process, the natural person or legal entity receives an identification number and chooses a password which is validated by LA DENT DU CHAT and this information is confirmed by the sending of a summary e-mail by LA DENT DU CHAT to the user.

Users are responsible for the confidentiality, security and proper use of their login and password.

Any use of the username and password of a certain user is assumed to have been made by that user.

LA DENT DU CHAT may temporarily or permanently make it impossible to use the user name and password if it appears that the user is in breach of one or more of the provisions of these General Terms and Conditions.

The party responsible for processing the user's personal data is: LA DENT DU CHAT.

This personal data is processed in LA DENT DU CHAT's data file for the purposes of customer administration, managing orders, deliveries, invoicing material and immaterial services, monitoring solvency, profile advertising, personalised processing and marketing.

LA DENT DU CHAT reserves the right to collect data about the user, in particular when the user places an order or through the use of cookies.

All personal data is intended for the internal use of LA DENT DU CHAT .

In accordance with the Law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, you have the right to access and rectify this data at any time, as well as the right to object if you no longer wish to be informed of our activities.

Further information concerning the protection of privacy in computer processing may be obtained from the Public Register (Commission for the Protection of Privacy, rue Haute 139, 1000 BRUSSELS).

Article 5: Delivery

The user has the choice of having the order delivered :

•     Either at home or at a third party's address.
•     Or to a LA DENT DU CHAT sales outlet.
•     Or to one of our markets.

LA DENT DU CHAT s’engagent à effectuer les livraisons des articles commandés dans les plus brefs délais.

Le délai moyen observé pour les articles disponibles, est de 7 jours.

Pour les retraits des colis au lieu d’exploitation, une pièce d’identité en vigueur est exigée. A défaut, les produits commandés ne pourront être délivrés.

Tout problème de livraison (article manquant ou abîmé) doit nous être signalé dans un délai de 48 heures au 0479/89.50.49

L’article retourné correspondant doit alors nous parvenir dans les 15 jours après réception en demandant l’échange ou le remboursement.

Une participation forfaitaire de 4,9 € est demandée pour les frais de traitement et d’expédition de votre colis à Bruxelles et de 7,9€ pour les frais de traitement et d’expédition de votre colis dans le Brabant Flamand et Wallon, celle-ci reste dûe même en cas de retour total ou partiel de la commande.

Article 4 : Tarifs Les prix des produits et services affichés sur le site sont indiqués en euros toutes taxes comprises (TVA et autres taxes applicables). Le vendeur se réserve le droit de modifier ses prix à tout moment. Néanmoins, les prix applicables à la commande sont ceux en vigueur au moment de la confirmation de celle-ci. Les prix indiqués ne comprennent pas les frais de traitement de commandes, de transport et de livraison pour autant qu’elles aient lieu dans les zones géographiques prévues ci-après.

Article 6: Price - Terms of payment

Le prix est exprimé en euros.

Le prix indiqué sur les fiches produit ne comprend pas le transport.

Le prix inclut la TVA (lorsqu’elle est applicable). Les ventes sans TVA à des non-assujettis ne sont possibles que dans la mesure où les pièces justificatives sont produites préalablement.

Lors de la validation de la commande, vous choisissez l’un des modes de paiement suivant (tous sont entièrement sécurisés) : le serveur est en mode crypté et toutes les informations véhiculées sont codées. Rien ne transite en clair sur notre site.

1° Par carte bancaire :

Vous indiquez votre numéro de Carte Visa ou MasterCard, le numéro de contrôle ainsi que la date d’expiration.

Le prélèvement intervient, après la facturation de vos articles, selon les modalités convenues avec votre banque.

Article 7: Security of electronic fund transfers

Transaction procedures on the site are carried out with the secure payment service provider Ogone.
This service guarantees that sensitive data is transmitted and stored in accordance with the highest security standards.

How it works :

• The user logs on to the website, selects items, places them in their shopping basket and expresses their wish to place an order.
• After registering, the user enters their delivery and billing details. The total amount of the order and the delivery charges are indicated.
• After receiving a full summary of their order, users confirm their wish to proceed to the payment stage.
• The user is redirected transparently to the payment service website, where they enter their payment parameters (payment method, homebanking, credit card number, etc.).
• Payment is requested from the financial institution concerned.
• The user receives the result of the transaction, which they can print out and keep as authentic proof.
• LA DENT DU CHAT carries out the automated post-sales processing and sends the package to the user.

All transaction costs are borne by LA DENT DU CHAT.

Article 8: Right of renunciation

The purchaser has the right to notify LA DENT DU CHAT that he/she renounces the purchase without paying a fine and without giving a reason, within 3 working days from the day following delivery of the order.

The user's notification must be made by e-mail. The cost of returning the parcel is always borne by the user.

The customer will be asked to protect the returned items with the utmost care.

For greater speed, when the user returns an item, LA DENT DU CHAT offers to reimburse you by transfer to your bank account.

To take advantage of this service, simply enter your bank account number on the packing slip that accompanies the returned items.

We will make the transfer as soon as possible (maximum 30 days).

In the event of improper returns, LA DENT DU CHAT reserves the right to refuse a subsequent order.

Article 9: Liability

LA DENT DU CHAT only has an obligation of means for all stages of access to the site, the order process and the delivery of subsequent services.

LA DENT DU CHAT may not be held liable for any inconvenience or damage inherent in the use of the Internet network, in particular a break in service, external intrusion or the presence of a computer virus or any event qualified as force majeure in accordance with Jurisprudence.

Products are sent by the usual postal services or by carrier.

LA DENT DU CHAT declines all responsibility in the event of excessively long delivery times due to the postal services or means of transport, as well as in the event of loss of the products ordered or strikes.

The risks of transport are borne by the user, who must make the usual requests to the postal services or the carrier.

Furthermore, it is specified that ownership of the products ordered will only be transferred to the user on full payment of the invoiced price, including the costs of processing this payment.

LA DENT DU CHAT cannot be held responsible for damages of any nature, whether material, immaterial or physical, which may result from the malfunction or improper use of the products sold.

The same applies to any product modifications resulting from suppliers.

LA DENT DU CHAT's liability will in any event be limited to the amount of the order and cannot be held liable for simple errors or omissions that may have occurred despite all the precautions taken in the presentation of the products.

LA DENT DU CHAT cannot be held liable to a customer or a third party for any indirect damage, loss of business, profit or turnover arising in any way whatsoever.

Most of our products are covered by the legal guarantee of conformity, the legal guarantee against hidden defects and the manufacturer's guarantee, the extent and duration of which vary depending on the product and brand.

Whatever the problem with your item, it is essential that you enclose a copy of the invoice, the warranty certificate (included in the box) and the returns form with the faulty appliance.

Please note that the guarantee does not apply to the repair of damage resulting from a cause external to the appliance (accident, lightning, fuses, current fluctuation, etc.) or from a fault on the part of the user resulting, for example, from use or installation that does not comply with the manufacturer's specifications, use that is detrimental to the good preservation of the appliance, use for commercial or collective purposes, etc.

In the case of products that do not comply with the information given when the products are presented on the site, they will be replaced or reimbursed depending on the availability of similar products and the wishes of the user.

The following are excluded from the guarantee: products modified, repaired, integrated or added by the user or any other person not authorised by the supplier.

The warranty will not cover any apparent defects or lack of conformity of the product, for which any claim must be made by the user within 7 days of delivery of the products, failing which the warranty will lapse.

The guarantee will not cover products damaged by misuse.

In all cases, LA DENT DU CHAT cannot be held responsible if the manufacturer refuses to apply its guarantee for the reasons set out above.

Article 10: Intellectual property

All elements of the LA DENT DU CHAT site, whether visual or audio, including the underlying technology, are protected by copyright, trademarks or patents and more generally by intellectual property.

They are the exclusive property of LA DENT DU CHAT.

The information, logos, drawings, trademarks, models, slogans, graphic charters and, in general, the advertisements and their content accessible via the Website are protected by intellectual and/or industrial property law.

Unless expressly authorised to do so by LA DENT DU CHAT and/or the third party concerned, the user is not authorised to modify, reproduce, rent, borrow, sell, distribute or create derivative works based in whole or in part on the elements present on the Website.

It is therefore forbidden to copy, modify, create a derivative work, reverse engineer, assemble or in any other way attempt to find the source code, sell, assign, sub-license or transfer in any way whatsoever any rights relating to the Website and its content.

The user is expressly referred to the national provisions relating to the protection of databases and computer programmes and, more specifically, to the laws of 31 August 1998 relating to the legal protection of databases and 30 June 1984 relating to the legal protection of computer programmes.

Any user who has a personal Internet site and who wishes to place, for personal use, on his site a simple link referring directly to the Home Page of the LA DENT DU CHAT site must request authorisation from LA DENT DU CHAT. This would not constitute an implicit affiliation agreement.

On the other hand, any hypertext link to the LA DENT DU CHAT website using the framing or in-lining technique is formally prohibited.

In all cases, any link, even tacitly authorised, must be removed on simple request from LA DENT DU CHAT. They are the exclusive property of LA DENT DU CHAT.

Article 11: Invalidity

Should any of the clauses of this contract be rendered null and void by a change in legislation or regulations or by a court ruling, this shall in no way affect the validity of and compliance with these General Terms and Conditions of Sale.

Article 12: Duration

The present conditions apply for the entire duration of the online services offered by LA DENT DU CHAT.

Article 13: Proof, storage and archiving of transactions

The computerised registers kept in the computer system of LA DENT DU CHAT and its partners under reasonable security conditions will be considered as proof of communications, orders and payments between the parties.

Order forms and invoices are archived on a reliable and durable medium so as to correspond to a faithful and durable copy.

Article 14: Miscellaneous

The items sold by LA DENT DU CHAT conform to the description and presentation given in the catalogue and/or on the website.

Despite all our precautions, errors may have crept into the catalogue and website. Under no circumstances may we be held liable for such errors.

Except in the case of contractual or legal provisions to the contrary, any transaction between LA DENT DU CHAT and the user, which is not contested within one month of delivery, may no longer give rise to a complaint.

Article 15: Applicable law and jurisdiction

These Terms and Conditions are governed by Belgian law. In the event of a dispute, Belgian law shall apply and only the courts of the judicial district of CHARLEROI shall have jurisdiction.
